Criminal Law
Someone in my family has been arrested. What should I do first?

Bail
What is the difference between pre-arrest and post-arrest bail?
Pre-arrest bail protects a person from being arrested, while post-arrest bail is for someone who is already in custody. Pre-arrest bail is treated as an extraordinary remedy, so the court looks closely at whether the case appears to be motivated by malice.
Which court should a bail application be filed in?
A bail application usually starts before the Magistrate or the Court of Session, depending on the offence, and can go to the Peshawar High Court if it is refused. The right starting point depends on the offence and the stage of the case.

Yes, bail can be cancelled, for example if the accused misses hearings, misuses the bail or tampers with evidence or witnesses. A complainant can apply for cancellation.
Family Law

Yes, what you share during a consultation is treated in strict confidence.
Which court hears family cases?
Family cases are heard by the family court of the district. Depending on which judge decided the case, an appeal goes to the district court or to the Peshawar High Court, and some decisions can only be challenged on limited grounds.

What is the difference between khula and talaq?
Khula is a dissolution of marriage sought by the wife through the family court, while talaq is pronounced by the husband and processed through the union council. In khula, the wife may be asked to give up or return the dower.
Can a wife get khula if the husband does not agree?
Yes, the family court can dissolve the marriage on the basis of khula even if the husband does not agree, once its effort at reconciliation has failed. The husband is summoned and given a chance to be heard.
Where is a khula suit filed?
A khula suit is filed in the family court, commonly in the district where the wife ordinarily resides. For wives living in Nowshera or Peshawar, that is usually the family court of that district.
Does the wife lose her haq mehr in khula?
Often the wife is required to give up or return the dower she received, but the court decides this on the facts. It is one of the points to discuss before filing.
Does talaq take effect immediately?
No, under the Muslim Family Laws Ordinance, 1961, talaq does not take effect until 90 days after written notice is delivered to the union council chairman. If the wife is pregnant, it takes effect when the pregnancy ends, if that is later.

Who gets custody of a child after divorce in Pakistan?
There is no automatic answer: the family court decides on the basis of the child's welfare. Mothers are generally preferred for young children, but the court considers the full circumstances of each case.
What is the difference between custody and guardianship?
Custody is about who the child lives with, while guardianship covers legal decisions about the child's person and property. A mother can have custody while the father remains the natural guardian.
Can a father meet his children if the mother has custody?
Yes, the court can set a visitation schedule so that the parent without custody can meet the children. Meetings can also be arranged on an interim basis while the case is pending.
Which court hears custody cases?

It can: where a child is old enough to form an intelligent preference, the court may take it into account. It is one factor among several in deciding what is best for the child.
